3. Cancellation and Refund Policy

The Academy adheres to the New Mexico Administrative Code 16.34.8.19 – School Tuition Refund and Settlement Policy, as follows:
3.1 Pre-Class Cancellation:

  • If a student cancels enrollment more than three (3) business days after signing the contract but before starting classes, a full refund of all monies paid will be issued, less an administrative fee of up to $200 or 15% of tuition and fees, whichever is less.

3.2 Withdrawal After Classes Begin:

  • For students who withdraw after starting classes, the Academy will retain a percentage of tuition based on the percentage of scheduled time enrolled:

  • 0.01% to 4.9%: 20% of tuition retained

  • 5% to 9.9%: 30% of tuition retained

  • 10% to 14.9%: 40% of tuition retained

  • 15% to 24.9%: 45% of tuition retained

  • 25% to 49.9%: 70% of tuition retained

  • 50% and over: 100% of tuition retained (no refund)

  • A cancellation fee of up to $150 may also apply.

3.3 School Closure or Course Cancellation:

  • If the Academy permanently closes or stops offering instruction after enrollment, a pro-rata refund of tuition will be provided.

  • If a course is canceled after enrollment, the Academy will provide a full refund or offer completion of the course at a later date.

3.4 Non-Refundable Items: Costs for non-refundable items (e.g., books, supplies) will be deducted from the total before applying any tuition refund.
3.5 Third-Party Financing: If tuition contracts are sold or transferred to third parties, both the Academy and the third party will comply with this refund policy.

4. Attendance and Testing

4.1 Mandatory Attendance: Attendance at all scheduled classes, refreshers, and training sessions is mandatory. Failure to attend a refresher will result in test cancellation and a rescheduling fee of $225.
4.2 Test Attempts: Students are permitted three (3) CDL test attempts within a one-year period. The first attempt is included in the tuition. Subsequent attempts incur a retest fee of $375. Failure to pass after three attempts requires a one-year sit-out period before reattempting the licensing process.
4.3 Scheduling: Test sites may be delayed by approximately two weeks. Students must maintain flexibility and communicate any scheduling conflicts (e.g., work schedules) to the Academy as soon as possible to coordinate with the test site.

5. Student Conduct and Safety

5.1 Safety Protocols:

  • Students must use three-point contact when entering/exiting trucks and wear enclosed footwear at all times in or around vehicles.

  • Yard speed must not exceed 5 mph to ensure the safety of pedestrians, including other drivers and children.

  • Students must immediately comply with instructors’ emergency instructions to stop vehicle actions for safety reasons.

5.2 Behavioral Expectations:

  • Argumentative or threatening behavior toward instructors or other students is strictly prohibited and may result in dismissal from the program without refund.

  • Cell phone use must be kept to a minimum. When not driving, students should actively listen to the training activities.

5.3 Hygiene: Students must maintain personal hygiene to ensure a comfortable environment in the enclosed cab.

6. Facilities and Resources

6.1 Parking: Vehicles must be parked against the fence line on the north side of the training pad, pulling in forward and backing out carefully to avoid damaging fencing.
6.2 Restroom Facilities: Restrooms are available in the main building, and a weekly-serviced port-a-potty is provided at the training pad.
6.3 Driver’s Room: Students may use the driver’s room, where food, water, coffee, and soft drinks are available.

7. Academic and Learning Guidelines

7.1 Entry Level Driver Training (ELDT): Students are enrolled in the mandatory online Entry Level Driver Training, which must be completed before requesting a test. Contact your instructor for login issues.
7.2 Study and Rest:

  • Students should study learning materials for one hour daily, avoiding “cramming” to promote retention.

  • A full eight hours of sleep is critical for memory consolidation and safe driving, as sleepy driving is more dangerous than drunk driving.

  • Proper nutrition is essential for mental sharpness during training.

8. Liability and Termination

8.1 Liability: The Academy is not liable for personal injuries, property damage, or losses incurred during training, except as required by law. Students participate at their own risk and must follow all safety protocols.
8.2 Termination: The Academy reserves the right to terminate a student’s enrollment for violations of safety protocols, disruptive behavior, non-payment, or failure to meet attendance or performance requirements. Refunds, if applicable, will follow the refund policy outlined in Section 3.

9. Amendments

The Academy reserves the right to update these Terms and Conditions at any time. Students will be notified of changes via email or during class announcements. Continued participation in the program constitutes acceptance of the updated terms.
